Provider: Matthias Jakisch, Hauptstr. 34, OT Etingen, 39359 Oebisfelde-Weferlingen, Germany, phone +49 39059 974988, e-mail support@codixio.com, sole proprietorship (no commercial register entry), operating under the trade name Codixio, VAT ID DE296346917, small business under Sec. 19 UStG. These terms apply to the use of the Shopware app Codixio EmpCo Product Info. The offer is addressed exclusively to entrepreneurs within the meaning of Sec. 14 of the German Civil Code (BGB); contracts with consumers are excluded.

2. Conclusion of contract

The contract is concluded by installing the app from the Shopware Store. Purchase, billing and cancellation of the base rent and in-app purchases take place via the Shopware Store and its in-app purchase system under the terms of shopware AG applicable there.

3. Services and plans

Standard (base rent, EUR 4.90 per month): custom fields for repairability, spare parts, manuals, restrictions, software update period, guarantee; information block on the product page in three selectable positions; short notice in cart and checkout; harmonised notice on the legal guarantee under Annex I and harmonised guarantee label under Annex II of Implementing Regulation (EU) 2025/1960 in 24 EU languages; exclusion flag; inheritance to variants. Plans are cumulative. The prices displayed in the Shopware Store apply; prices are net. As a small business under Sec. 19 UStG, the provider does not charge VAT.

4. Plan changes

An upgrade takes effect immediately. On a downgrade or when an in-app purchase ends, the features of the higher plan are no longer available; maintained fields, settings and compliance copies are retained and not deleted. Compliance copies remain exportable until their retention period ends as long as the Enterprise plan is active.

5. Term and cancellation

Base rent and in-app purchases run monthly and renew automatically unless cancelled via the Shopware Store at the end of the billing period. Uninstallation ends use; the rules of the Shopware Store apply to billing.

6. Merchant obligations

The merchant maintains the product and manufacturer information itself and is responsible for its accuracy, completeness and lawfulness. It ensures that its own privacy policy names the provider as processor insofar as it uses a plan from Pro upwards. It does not use the app abusively and does not interfere with the backend interface.

7. Delimitation from statutory duties

The app technically maps the information under Art. 246a Sec. 1 para. 1 nos. 11, 11a, 11c, 20 and 21 EGBGB and under Art. 19 of Regulation (EU) 2023/988 and shows the legal reference per field in the administration. The harmonised notice and the harmonised label are delivered unchanged from the templates published by the European Commission. Whether and to what extent these duties apply to the merchant, which products are affected and whether a statement is correct in an individual case is assessed by the merchant; the app makes no statement on this and does not replace legal advice.

8. Availability

The provider endeavours to keep the backend highly available and remedies faults with due care. Maintenance is carried out outside usual business hours where possible. No specific availability rate is guaranteed. The features of the Standard plan run entirely within the shop and are independent of backend availability.

9. Rights of use

For the term of the contract, the merchant receives a simple, non-transferable right to use the app in the shops for which it was purchased. Rights in the app remain with the provider. The included official templates of the European Commission and the Inter typeface are subject to their own licence terms.

10. Liability

The provider is liable without limitation for intent and gross negligence and for injury to life, body or health. For slightly negligent breach of material contractual obligations, liability is limited to the typical, foreseeable damage; otherwise liability for slight negligence is excluded. Liability under the Product Liability Act remains unaffected. The provider is not liable for the substantive accuracy of the information maintained by the merchant or for the fulfilment of the merchant's statutory duties.

11. Data protection

The privacy policy at https://legal.codixio.com/apps/empco-product-info-shopware/privacy.en and the data processing agreement at https://legal.codixio.com/apps/empco-product-info-shopware/dpa.en apply.

12. Changes

The provider may amend these terms with effect for the future where necessary for legal or technical reasons and the contractual balance is preserved. Changes are announced at least four weeks before they take effect via the administration or by e-mail; if the merchant does not object before they take effect, the changes are deemed accepted; the announcement will point out this consequence.

13. Final provisions

German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Should a provision be invalid, the remainder of the contract remains valid. The version published at https://legal.codixio.com/apps/empco-product-info-shopware/terms.en applies.
